Galveston Med Mal Lawsuit Filed After Elderly Woman Discharged Early

The family of a woman who died in a League City nursing home is filing a TX medical malpractice lawsuit against the doctor who discharged her from one facility and sent her to another without the permission of her loved ones. The lawsuit states that the doctor violated doctor-patient trust and that the transfer was a direct cause of the woman’s death.
In September of 2008, Jeanie Kilgore was placed in the Baywind Village nursing home by her family, Clay and Ricky Kilgore. Jeanie suffered from Parkinson’s disease and dementia and needed professional care. However, weeks after she was admitted to the care facility, Dr. Firoozeh Saheb Kar transported the woman to a different nursing home without contacting her family. At that nursing home, the family alleges, the nursing home staff was not able to care for the woman or her medical issues. After she aspirated vomit in early October, she was found unconscious on the floor and later died at Clear Lake Regional Hospital.
Her family is suing Baywind Viliage, Dr. Kar, and the ambulance company that transported Kilgore to the new facility. It is unclear why the doctor decided to discharge the woman or why he transferred her to another facility without her family’s knowledge.
The Dallas medical malpractice lawsuit was filed in Galveston County District Court on September 30. The family is seeking $5.5 million in damages.
