Jefferson County Widow Settles Suit With Nursing Home About Falls

After her elderly husband died as a result of his multiple falls, a Texas widow is suing a number of organizations for medical malpractice because she says the falls should have been prevented and were cause by nursing home neglect.

According to the Southeast Texas Record, Onita Bennett filed medical malpractice lawsuits against Pine Forest Nursing and Rehabilitation Centers, Southeast Texas Medical Associates (SETMA) and Dr. Syed Anwar. The lawsuit stated that the parties involved failed to properly supervise her weak and elderly husband Elwood, causing a fall that broke his hip and led to complications. Even though Elwood suffered from frailty and dementia, Onita says that he was allowed to attempt to use the bathroom by himself or walk unsupervised to a friend’s room. These mistakes in his care plan led to multiple serious falls and serious injuries, including a fractured hip and a brain hemorrhage. These injuries, she said, led to a great deal of pain and suffering as well as her husband’s untimely death.

Onita settled privately with two of the above parties and was planning to go to court against the remaining entities. However, after the Jefferson County judge rejected an appeal based on the prosecution’s Texas medical expert, the final two parties settled with Bennett out of court. She was asking for compensation for medical expenses as well as the pain and suffering of her husband, including physical pain, mental anguish, physical impairment, and disfigurement.
