Texas Family Wins $2.25 Million Nursing Home Wrongful Death Case

A Texas man who lost his wife of 50 years to a staph infection has won a $2.25 million wrongful death lawsuit against a troubled nursing home that could have easily prevented a woman’s death.

Cynthia Wilms was a patient at the Willows Nursing & Rehabilitation Center in the summer of 2007 after a hip replacement surgery necessitated extra nursing care and attention. However, the nursing home ignored the 72-year-old woman’s obvious and easily treatable post-operation infection that festered and spread over a series of months. She died in September.

Her husband, Phillip, sued the mega company that owed the nursing home, Extendicare Health Services, Inc. He, and his Texas daughter Susan, has won one of the largest nursing home neglect cases on record in the state.

The deadly mistake that the nursing home made, the family says is woeful understaffing. During the time that Wilms was at the nursing home, the adult care facility was below their minimal staffing needs 20 percent of the time – and though Wilms infection was noted several times in her records, a call to a doctor was never made. Phillip has said in a statement that while he does not blame the harried and under-trained nurses, he does blame the corporation, which places profit over the needs of their residents. The nursing home company has been the subject of nursing home abuse and neglect cases often in the past.
