Texas Man Files Injury Lawsuit after Forklift Accident

Posted on Jan 31, 2012

A Galveston County man has filed a Texas personal injury lawsuit against a seafood company after he sustained a serious foot injury while at a warehouse owned by the company.

According to the Southeastern Texas Record, Ramis Castellon was waiting to speak with a supervisor at a Galveston seafood warehouse when his foot was run over by a forklift. He was rushed by ambulance to the University of Texas Medical Branch, where he was treated for a serious foot injury. Since that time, he has received ongoing treatment for his fracture injury.

Worker Eleaszar Gonzalez was operating the forklift at the time of the premises liability incident.

The injury lawsuit, which was filed in Galveston County District Court, is against Texas Gulf Seafood, Inc. Castellon states that the forklift that injured his foot did not make a warning sound as it was moving in reverse because the warning signal on the heavy machinery was broken or disabled. The lawsuit goes on to say that the seafood company was negligent in fixing the warning signal or warning visitors of the danger – and that its negligence created a dangerous property that exposed others to an unreasonable risk of injury.

Castellon is seeking $75,000 in damages – an amount that includes his pain and suffering and his medical bills.
