Texas Woman Files Birth Injury Lawsuit Regarding Shoulder Dystocia

After her son allegedly suffered permanent injuries during labor and delivery, a Victoria woman has filed a Texas birth injury lawsuit against the physician and the clinic where the delivery took place.
According to the Victoria Advocate, Anna Flores is suing Dr. Tanya Seiler and the Victoria Women’s Clinic after her son, Natividad Barrientes, suffered shoulder dystocia during his birth in November 2010.
The birth injury lawsuit states that the clinic and the physician should have known that Flores and her baby were at risk for complications due to Flores’ diabetes, Flores’ obesity, and the high gestational weight of her unborn baby. In addition, doctors should have recognized the complication earlier and taken different actions to free the baby than immediately pulling the baby by its head.
While the specific injuries that Natividad suffered remain unclear, shoulder dystocia can result in permanent nerve damage, loss of feeling in the arm and hand, paralysis, broken bones, and even brain damage. In addition, shoulder dystocia can also put the mother in danger. The complication affects about one out of 100 births.
Flores is seeking compensation for the birth injury to cover past and future medical costs, lost future wages, lowered earning capacity, physical impairment, disfigurement, and pain and suffering.
