Texas Woman Sues Wal-Mart After Breaking Hip In Beaumont Fall Accident

A Beaumont woman has filed a personal injury lawsuit against corporate giant Wal-Mart after she claims that she fell and injured herself while in a store after tripping on a floor display. She is suing for unspecified an unspecified amount for medical costs, court fees, interest, mental anguish, pain, and disfigurement.
The Texas woman filed her premises liability lawsuit in Jefferson County, where U.S. District Judge Marcia A. Crone will preside over the case. According to court papers, the slip and fall accident took place in January of this year when Patricia Morrison was shopping in Sam’s Wholesale Club, a chain of stores owned and operated by Wal-Mart. During her shopping trip, she tripped on a floor display and fell to the ground, breaking her hip and femur.
Morrison believes that Wal-Mart was negligent and should have prevented her fall injury. She believes that the floor display was poorly placed and improperly maintained – and that the display should have either been blocked off from customers or had warning signs displayed cautioning shoppers of the hazard.
When hearing the case, the premises liability judge will likely try to determine whether the floor display was a real hazard to customers, whether Wal-Mart should have known about the danger of the display, and whether Morrison should have been aware of the display and walked around it.
