Posted on Oct 23, 2011

A Texas man and his employer have been named in a Texas personal injury lawsuit after a Tyler couples claimed the man struck their vehicle and then left the scene of the traffic accident.

According to the Southeast Texas Record, Jerry Alan Garrett and Shanna Lee Garrett were driving on South Beckham Road in Tyler when their vehicle was struck by Richard Craig Loy, an employee of AdvoCare International who was on business for the company. The Garretts claim that Loy did not yield to traffic on South Beckham Road and that, after striking the vehicle, the man swore at them, waved obscene gestures, and then drove away without exchanging information or helping secure medical assistance for the injured.

Jerry Alan Garrett suffered significant injuries in the Tyler hit-and-run car accident and is seeking damages for medical expenses, lost wages, loss of earning capacity, pain and suffering, court fees, and interest. His wife is seeking damages for loss of companionship, loss of solace, loss of society, loss of comfort, loss of assistance, and loss of emotional support.

It is unclear whether Loy faced citations or criminal charges following the hit-and-run accident or whether he was injured in the crash. The civil case will be heard by Judge Michael H. Schneider in the Eastern District of Texas.
