Texas Attorney General Greg Abbott's office has filed a nursing home abuse lawsuit against Westridge Pinnacle Care, an adult daycare facility in Houston, Texas. The adult daycare lawsuit was filed after the Texas Department of Aging and Disability Services reported that elder abuse may be taking place at the nursing home and that residents may be in danger. In addition, it was also found that Westridge Pinnacle Care was operating without a license as of March 2010, although it is still unclear why their attempt to renew their license was denied.
According to the Houston Chronicle, Texas state investigator Ryan Dalton went to the adult daycare and found that one of the residents was being treated with physical violence and verbal abuse. One staff member had a man in a head lock and was reported to have said, You're not going to be violent! I'm the only one that is going to be violent! If you do it again, I'll bite your face off!”
The executive director and owner of the Texas nursing home, Hector Ibarra, did not comment on the allegations of elder abuse, though the employee accused of abuse denied that any physical contact was made.
In response to the TX nursing home lawsuit, a Montgomery County judge has issued a temporary restraining order against the adult care facility and insisted that the nursing home residents are moved to a safe home free of abuse and neglect until the matter is settled.
