Defective Medical Equipment that doctors, nurses and healthcare providers may include items such as:
Medical equipment is highly regulated by the Food and Drug Administration.
In a report by the International Trade Association, the U.S. is the largest consumer of medical equipment. Consequently, U.S. medical technology companies lead the world in medical equipment production. This means there are literally millions of medical devices in operation every day.
And, as a result, potential product liability claims exist because this medical equipment is defective or dangerous.
Case Examples of Faulty Medical Equipment
Faulty medical equipment can be caused by a number of factors. One of the reasons may be defective wiring. Recently, many lawsuits have been filed for defective heart defibrillators. According to The Mayo Clinic, heart defibrillators are implantable devices used to reduce the risk of dying, if the heart stops beating. This device is designed to deliver electrical shocks to restore heart rhythms; however, what if the defibrillator stops working?
Otto Morman had a heart defibrillator implanted after suffering a heart attack. The company that made his medical equipment, Guidant Corporation, issued a world-wide recall. In the company's recall notice, it was stated that the faulty medical equipment issued to Otto short-circuited in 28 patients and was accountable for death in some of the victims. Even though his defibrillator worked fine, he decided to have his replaced.
Over the summer, Medtronic Inc., makers of Kappa and Sigma pacemakers, were forced by the FDA to recall certain pacemakers due to separation of wires. Over 20,000 pacemakers were affected. Patients were experiencing a return of symptoms associated with abnormal heart rate, including fainting and lightheadedness. However, there were also cases were faulty pacemakers were to blame for serious injury or death.
In another report made by FDA, certain types of power cords used to power medical equipment were defective. The report stated two medical equipment manufacturers had sent in 122 incident reports of sparking, charring, and fires erupting from medical equipment. This can result in accidental electrical shock, delay in setup and therapy, and interruptions of therapy. There may even be cases where the faulty power cords could lead to serious injury or death.
