Why Food Recalls Can Be a Product Liability

Why Food Recalls Can Be a Product Liability

Everyone has to eat food to survive. However, what if the food you eat cause severe health problems to you or your family? Each year, pounds of food products are pulled from grocery aisles and warehouses due to some form of contamination.

Food recalls can be the result from people who suffer illnesses including salmonella and E. Coli after eating contaminated foods. Governed by the Food and Drug Administration, the inspection of food plays an integral part of society.
Some of the responsibilities the FDA include:

  • Protecting all food products (except meat and poultry) against tampering
  • Making sure the labeling is accurate and correct
  • Inspecting food and bottled water for possible contamination

According to MSNBC, a California-based food distribution company recalled Hola Pop candy because of high levels of lead. This product was imported from Mexico. This possible product liability caused pregnant women and children to become especially vulnerable to lead ingestion.

The lead induced from the candy can cause severe harm by damaging red blood cells and limiting the ability to carry oxygen to organs and tissues. Lead contamination can also lead to brain injury, aggressive behavior, hearing impairment and death,  Lead Action News reported.

On March 23, 2009, The  FDA requested that Westco Fruit and Nut Company voluntarily recall all of their products that contain peanuts due to a contamination threat. However, the company did not commence to do so. On April 8, the FDA served an inspection warrant to gain access to the company's distribution records. Retailers were urged to stop selling the recalled products.

The Texas Department of State Health Services issued a warning to consumers not to eat certain imported dried plums and products containing imported dried plums. Their reason - the plums have elevated levels of lead. These products are thought to come from Asia. Test results indicated that the product contained lead levels ranging from 0.11 parts per million to 30.3 parts per million.

Vatran's Fine Foods Inc, a California firm, issued a food recall of over 11,500 pounds of assorted meat and poultry products. It was because the U.S. Department of Agriculture's Food Safety and Inspection Service did not inspect the products.
