Do Not Be Discouraged If Your Social Security Disability Claim Has Been Denied – Most Claims Disability Claims Are Denied and Must Be Re-Filed

If your application for Social Security Disability benefits has been denied, or your request for rehearing has been unsuccessful, The Rasansky Law Firm can help. Social Security Disability Qualifications

You may qualify for Social Security Disability Benefits if

  • If you are disabled due to an injury AND
  • If you have paid Social Security taxes for five of the LAST ten years while working.

In order to QUALIFY for social security disability benefits, you must prove during the application process that you cannot perform ANY TYPE OF WORK and that your disabling condition will last twelve months or even longer.

Social Security Benefits

The amount of Social Security Disability Benefits one can receive depends on several different factors including the following:

  • How much income you earned while you worked;
  • The amount of your contributions to the Social Security system during the period of time you worked;
  • The amount of workers' compensation, if any, you are receiving.

Social security disability payments do not begin until the first full month after the five month waiting period after the date the There is a five (5) month waiting period before social security disability benefits begin.

 

Social Security Disability Benefits will not begin until the sixth full month of your disability because there is a five month waiting period. The Social Security Office determines when your disability began.


Social Security Application Process

To apply for Social Security Disability Benefits you can go to your local Social Security Office or call the regional Social Security office at 800-772-1213. 


More often than not Social Security Disability Claims are denied, but don't let that discourage you.

If you are initially denied Social Security Disability Benefits you can appeal the decision. All appeals must be filed with 60 days of a denial at any stage in the process of determining Social Security Benefits received.

If your reconsideration has been denied, you can then request a hearing with an Administrative Law Judge within 60 days of the denied reconsideration. At this hearing you will present your disability claim to the Administrative Law Judge in which the Administrative Law Judge will hear testimony and review your doctor's reports, your records, and your Application. The Administrative Law Judge can take several months or longer before issuing a decision in your case.
