Whistleblower Files Lawsuit Against Nursing Home

A nurse who was fired from her job is alleging that the employer let her go because she reported patient neglect. The lawsuit is detailed in SETexasRecord.com. According to the whistleblower lawsuit, the nurse in question had complained that caregivers at the home care agency she worked for were not attending to patients properly. She further alleges that the employer told her not document any of the incidents and to not document how it affected patients.
The woman was let go from her job about two weeks after the incident, according to the report. The woman as allegedly let go for unprofessional behavior, inappropriately documenting records and crossing professional boundaries, according to her former employer. The woman alleges that she was the victim of retaliation.

Caregivers and Fighting Abuse

While there are plenty of legal actions filed because caregivers are negligent or abusive outright, there are also actions filed because the caregivers try to help but are road blocked by their employers. These types of lawsuits don’t typically involve the families of the abuse or neglect victims, but they are telling for those who are considering filing a lawsuit over neglect by a nursing home or a home care facility.
If you suspect abuse, your suspicions may be confirmed by good-hearted caregivers. There are so many lawsuits against elder care facilities that it’s sometimes easy to forget that most of the people who work in this field are genuinely motivated to help people and, in addition to that, they don’t want their own professional reputations sullied by association with a bad facility or company.
If you have reason to believe that your loved one isn’t being given the care they need, you may want to consider talking to some of the caregivers to see what they think. Realize that these people may be afraid of losing their jobs of they speak up, but some of them might be willing to do so, particularly if the abuse is egregious.
The staff at nursing homes and, sometimes, the administration, may be very unhappy with the conduct of the company for which they work. Failing that, you may want to contact the family members of other patients—or talk to them at the facility—and see if they have any suspicions themselves.
